P-1 VISA The P-1 Visa is for alien athletes who compete individually or as a part of a team at an internationally recognized level, and for aliens who perform with an internationally recognized entertainment group. The P-1 visas have been issued to alien entertainers, circus artists, and athletes who wish to work in the U.S. However, notice should be given to the different treatment to athletes as opposed to entertainers. Athletes may apply for this visa in order to compete in the U.S., either as individuals or as members of an internationally recognized athletic team. However, entertainment groups with an outstanding international reputation can be granted P-1 classification as a unit. Individual entertainers within these groups cannot apply for separate visas.. The spouse and unmarried children under the age of 21 of a P-1 Visa holder are permitted to accompany the P-1 principal to the United States, under a P-4 status. As P-4 visa holders, they can attend schools or universities, but cannot legally work without a work visa. Servants of a P-1 visa holder may receive a B-1 visa with work authorization. Procedures The employer must submit Form I-129 and all supporting documents to the INS branch with jurisdiction over the area where the alien plans to compete or perform. A U.S. agent may also file a petition for workers who are self-employed, use agents to book short term engagements with many different employers or in situations where foreign employer(s) authorize the use of an agent to act on their behalf.
